Charlie Sheen and Brooke Mueller have officially filed for divorce.

The ‘Two And A Half Men’ actor has been estranged from Brooke since they had a huge fight last Christmas Day (25.12.09) – which led him to plead guilty to misdemeanour assault and resulted in him being given a 30-day suspended prison sentence.

The 45-year-old star underwent a long stay in rehab after the domestic incident but last week suffered a relapse and trashed a New York hotel room after a drug and alcohol fuelled party with a porn star escort.

Both Charlie and his third wife Brooke, 33, filed divorce papers at Los Angeles Superior Court yesterday (01.11.10), with Charlie seeking custody of their twin 18-month-old sons Bob and Max and citing “irreconcilable differences” as the reason for their separation.

The papers also indicate the couple had a pre-nuptial agreement before their 2008 wedding.

Brooke’s papers seek sole custody of Bob and Max as well as spousal support, with visitation rights for Charlie.

Documents obtained by gossip website TMZ reveal the couple had already signed a different agreement in May, which divided their assets in the case of a divorce. The 43-page property settlement had been signed by both Charlie and Brooke and also agrees on child custody.

According to the document, Brooke gets primary physical custody and Charlie gets visitation rights.

Brooke is also to receive $55,000 a month according to the document, which also states “under no circumstances” shall the child support paid by Charlie for Bob and Max be less than that paid to his second wife Denise Richards for their children for Sam and Lola.

According to Charlie’s court documents, he gets to keep the family house but has to pay Brooke over $1 million for the property and a parting lump sum of around $803,745. He also gets to keep his watch collection which is worth almost $5.5 million.

Charlie – who earns an estimated $600,000 per episode of ‘Two And A Half Men’ – also believes any money he made after their December 25 argument, the date of their separation, belongs to him alone and isn’t subject to community property laws, as are any earnings made before their 2008 wedding.

Well… as long as he get to keep the watch collection I suppose…
